By accessing and using the Revival Moments website and services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.
## 2. Service Description
Revival Moments offers the following services:
- Digital restoration, enhancement, and generation of short videos.
All services include digital delivery of final products.
**Important Notice on AI-Generated Content:** Our services are powered by artificial intelligence. The AI-generated outputs and results do not represent the views, positions, opinions, or attitudes of Revival Moments. All responsibility for the use of generated content rests with the user. Users agree to use generated outputs responsibly and in accordance with all applicable laws and these Terms of Use.
## 3. Ordering and Pricing
### Pricing
Prices are displayed in British Pounds (GBP) and are subject to change without notice. Current pricing is as listed on our website at the time of order placement.
Customers may specify which photos to animate and preferred motion styles. Each motion style counts as one (1) separate video.
### Order Placement
By placing an order, you confirm that:
- You have the right to provide the photos/content to Revival Moments
- You have obtained all necessary permissions from individuals pictured in the photos
- The information you provide is accurate and complete
- You authorise payment via the method selected
### Payment Terms
- Payment is required at the time of order placement
- Payment is processed securely through our payment provider
- All transactions are non-refundable even if you are not satisfied with the result due to the randomness of Artificial Intelligence (AI). Once processing begins, AI computation uses non-recoverable computing resources that cannot be refunded or reused, regardless of final output quality.
## 4. Delivery Timeline
### Standard Processing
- **Photo Services**: 5-7 business days from order confirmation and receipt of all materials
- **Video Services**: 7-10 business days from order confirmation and receipt of all materials
- **Digital Delivery**: Files are provided via secure download link or email
Processing times exclude weekends and UK public holidays. Rush processing may be available at additional cost; contact us for details.
### Your Responsibilities
- Provide clear, complete instructions for all services
- Upload high-quality source photos (minimum 300 DPI recommended for print)
- Respond promptly to any clarification requests from Revival Moments
- Check deliverables for accuracy and report any issues within 7 days of delivery
## 6. Intellectual Property Rights
### Your Content
- You retain all ownership rights to photos and materials you provide
- By using our services, you grant Revival Moments a limited license to process, modify, and deliver the requested services
- You are responsible for ensuring you have the right to use all photos provided
### Our Work Product
- The finished deliverables (edited photos, videos, animated files) are created specifically for you
- You own the rights to use the final product for personal use
- Commercial use, redistribution, or resale of deliverables requires explicit written permission
- You may not claim Revival Moments' work as your own or publicly attribute it to others without acknowledgment
### Portfolio Use
You grant Revival Moments the non-exclusive right to:
- Display your work (with identifying information removed) in our portfolio or marketing materials
- You may opt out of portfolio use by noting this at order placement
- We will not identify you or your family members in portfolio displays
## 7. User Conduct and Prohibited Content
You agree **not** to use Revival Moments services for:
- Illegal activities or content that violates any applicable law
- Defamatory, harassing, abusive, or threatening content
- Copyrighted material you don't have permission to use
- Non-consensual intimate images or revenge pornography
- Content that exploits, endangers, or harms children
- Fraudulent, deceptive, or misleading content
- Weapons, explosives, or dangerous materials
- Content that violates others' privacy or intellectual property rights
Violation of these prohibitions will result in:
- Immediate termination of your order
- Forfeiture of payment with no refund
- Potential reporting to law enforcement
## 8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
Revival Moments is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Our liability is limited to:
- The amount you paid for the specific service
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- This includes loss of profits, loss of data, or business interruption
- This limitation applies even if we've been informed of the possibility of such damages
## 9. Indemnification
You agree to indemnify and hold harmless Revival Moments, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of our services
- Your violation of these Terms of Use
- Your violation of any applicable law
- Your infringement of any third party's rights
- Content you provide or authorize
## 10. Quality Standards
### Photo Services
- Colour restoration and enhancement to authentic or natural appearance
- Dust, scratches, and damage removal
- Upscaling using advanced AI technology to printable quality
- Revisions available if output doesn't meet specifications
### Video Services
- Smooth animation with preferred motion style
- HD (1080p) upscaling from original source
- 6-second or other duration specified in our service options in our website
**Note:** Output quality depends on source material. Severely damaged or low-resolution originals may have limitations. As AI-assisted services, results may vary based on algorithm processing and source photo quality.
## 11. Confidentiality
Revival Moments maintains strict confidentiality of:
- Customer names and contact information
- Specific details about photos or subjects
- Order contents and specifications
- Personal or family information discussed
We will not disclose this information except as required by law or as stated in our Privacy Policy.
## 12. Data and Content Security
- Your uploaded files are stored on secure servers with encryption
- Files are deleted within 30 days of order completion unless extended storage is requested
- We use industry-standard security practices to protect against unauthorized access
- We are not responsible for data loss due to circumstances beyond our control (natural disasters, server failures, etc.)
## 13. Dispute Resolution
### Informal Resolution
Before pursuing legal action, you agree to attempt resolution through:
- Email communication to our support team
- Detailed description of the issue and supporting evidence
- Good-faith negotiation period of 14 days
### Governing Law
These Terms of Use are governed by the laws of the United Kingdom, without regard to conflict of law principles.
### Jurisdiction

- SECURITY OR PRIVACY OF DATA
- SPECIFIC RESULTS OR OUTCOMES
SOME JURISDICTIONS DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU.
## 15. Termination of Service
Revival Moments reserves the right to:
- Suspend or terminate service to any user who violates these terms
- Refuse service to anyone at our sole discretion
- Delete inactive accounts and associated data after 12 months of inactivity
- Modify or discontinue services at any time
## 16. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Revival Moments regarding your use of our services. These terms supersede all prior agreements, representations, and understandings.
## 17. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in full force and effect.
